The “Clarity Act” – Finally, Some Clarity?
At the heart of the discussion is the revised Clarity Act, a bill originally championed by Senators Kirsten Gillibrand (D) and Cynthia Lummis (R). The goal? To finally clarify the division of labor between the SEC (which likes to position itself as the securities watchdog) and the CFTC (which oversees commodities). The Crypto Industry Is Divided
As always when regulation is on the table, the debate is fierce: some cheer, others warn. Ripple CEO Brad Garlinghouse called the Clarity Act “an important step in the right direction.” “We need legal certainty, finally,” he said. Others, like Meltem Demirors of CoinShares, fear that overly strict rules could benefit big players like Coinbase while stifling innovation.
And then there’s SEC Chair Gary Gensler—a man who seems to view crypto as a problem rather than an opportunity. Whether his agency will support the White House’s plans is far from certain. The U.S. is once again faced with a key question: Do they want to lead—or just watch as other countries, like the EU (with its MiCA law) or Dubai, set the rules for the future?

The Trump administration appears determined to bring the U.S. back to the forefront of crypto regulation. Alongside the Clarity Act, there could be additional measures—such as tax breaks for digital assets or incentives for crypto mining in states with low energy costs.
Will it all work out? Congress must approve, courts could intervene, and the SEC won’t simply stand by. But one thing is clear: The U.S. stands at a crossroads. Either it seizes the chance to take the lead—or risks falling behind other nations that have long recognized crypto’s importance for the future of finance.
