Thailand Cracks Down on Bitcoin ETFs with Strict Local Rules

Thailand is cracking down on crypto ETFs—and the move could have far-reaching consequences. The country’s Securities and Exchange Commission (SEC) is proposing severe restrictions on Bitcoin- and Ethereum-based ETFs, allowing them only if they are listed on the Stock Exchange of Thailand (SET) and held by licensed Thai custodians. The goal? To keep the domestic market under tight control and prevent capital flight.
But why the hard line? Thailand has always had a love-hate relationship with cryptocurrencies. On one hand, it became one of Asia’s first markets to approve Bitcoin and Ethereum ETFs in 2023. On the other, regulators fear risks like money laundering and capital outflows. The new rules aim to ensure Thai investors don’t divert funds to foreign exchanges in the U.S. or Singapore—instead, everything must flow through the SET and local custodians.
Not everyone is thrilled. Critics warn the strict regulations could stifle innovation, push investors to neighboring markets like Singapore or Malaysia, and distort competition by favoring the SET and established players. And there’s the question of compliance: The F



inancial Action Task Force (FATF) might frown upon such heavy-handed restrictions, while the Bank of Thailand could worry about reduced liquidity.
The crypto industry is divided. Some praise the plans as a step toward safety and transparency, while others fear they’ll strangle the local crypto trade. A local industry expert put it bluntly:
"If Thailand wants to lead in crypto, it should foster innovation—not smother it. Strict rules may bring short-term safety, but long-term, they’ll drive investors away."
Others see opportunity. The crypto exchange Bitazza welcomes the move as a way to build a "regulated and secure ecosystem," arguing that fair, transparent rules could boost investor trust.
Public consultation on the proposal runs until September 20, 2024. If approved, the rules could take effect in 2025. But big questions remain: How will existing foreign providers be handled? Can Thailand balance control and competitiveness?
One thing is certain: The crypto world is watching Bangkok closely. The outcome remains uncertain—but one thing is clear: Thailand is facing one of its toughest crypto regulation decisions yet.
