With growing demand for digital assets from major players like pension funds or hedge funds, this would be a significant step. ailable to institutions—but notorious for high fees and opaque custody practices. If the SEC changes its stance, new, more cost-effective and transparent products could emerge.
Not everyone is enthusiastic, however. Critics warn against overly lax regulation: "The balance between innovation and investor protection is crucial," says Krüger. "The SEC must ensure it doesn’t create new risks—such as through inadequately supervised custodians."
An international comparison also adds context: While the U.S. hesitates, countries like Switzerland and Germany have already established clear crypto regulations. "If the U.S. follows suit, it could strengthen its position as a global financial hub," Krüger notes. "Otherwise, institutional capital will simply flow to other jurisdictions."
The SEC has not yet made a final decision, but discussions suggest change is on the horizon. Should there indeed be a loosening of rules, it wouldn’t just transform the crypto market—it could reshape the entire digital financial ecosystem.
